Terms and Conditions of Sale
1. This price list is intended for the “Wholesale Trade” only.
2. This price list cancels all previous quotations written or verbal and is subject to change without notice.
3. All prices are F.O.B., our nursery, Greenthumb Nursery, Ether, N.C.
4. Delivery on our gooseneck trailer or flat bed trucks are available. An offloading fee of 10% will be charged to those customers who do not provide sufficient help for offloading or delays due to crews not being on the job site.
5. Cash or Check are accepted, as are MasterCard, Visa and Discover with a 3% Processing Fee of the total amount. American Express with a 4.5% Processing Fee of the total amount.
6. Credit will only be available to customers who purchase on a regular basis, initial purchases are COD. Complete credit terms are available with credit applications. A service charge of 1.5% per month (18% annual rate) shall be charged on all past due accounts, plus any costs incurred for collection. We reserve the right to cancel credit at any time.
CONDITIONS: We accept all orders on the conditions that they shall be void due to: prior sale (unless a deposit of 25% has been paid to secure the order for later pickup or delivery), incorrect count, or crop failure due to situations beyond our control.
GUARANTEE: We guarantee our stock to be healthy and true to name. We do not anticipate any claims. Liability ceases upon delivery to a trucking company and shall become the responsibility of the purchaser, except when delivered by us, then liability ceases upon delivery to the purchaser. Any claims must be made in writing within 48 hours of delivery. We will be happy to correct any mistakes made by us, but in no case will our liability exceed the purchase price.
The buyer understands that we give no warranty expressed or implied as to the productiveness of the stock hereby offered.
